SMS Communications & Mobile Information

Elav8 operates an SMS messaging program. This section supplements and, where it is more specific, controls over the rest of this Privacy Policy.

What We Collect Through the SMS Program

• The mobile phone number you provide.
• The exact consent text shown to you, the date and time you submitted the form, and the IP address and user-agent of the device that submitted it.
• Your responses to our messages (including but not limited to keywords such as STOP, HELP, START), and our delivery and engagement metadata.
• Any other information you voluntarily include in a reply.

How We Use SMS Information

• To send the categories of messages you opted in to.
• To honor opt-out requests within ten (10) business days, as required by the FCC, across SMS, voice, and email where you have provided contact information for any of those channels.
• To maintain records of your consent and revocation for the period required by applicable law and the consumer protection rules of the carriers and registries that route our messages.
• To investigate and respond to fraud, abuse, security incidents, and disputes about message delivery or consent.

How We Share SMS Information

We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

We do not sell, rent, or share your phone number or your SMS opt-in status with any party for that party's own marketing or advertising. We do not share your SMS opt-in status with affiliates for their independent marketing.

Consent Is Per-Channel and Independent

Consent to receive SMS messages from Elav8 is given separately from any consent you may give to receive AI-driven phone calls, automated voice messages, or marketing emails from Elav8. Each channel has its own opt-in checkbox on our forms.

Opting Out

You may opt out of SMS messages at any time by replying STOP to any message from Elav8, or by emailing [email protected] with the phone number you wish to remove. After we process the opt-out you will receive a single confirmation message and no further marketing or non-transactional messages.

Message Frequency and Charges

Message frequency varies. Standard message and data rates from your carrier may apply. Elav8 does not charge any per-message fee.

Mobile Information Sharing — Summary Statement

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of use exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
